Terms & Conditions
General terms for website use, inquiries and service requests. Each project proposal defines its specific commercial terms.
ZibaraTech and its services
ZibaraTech is an independent technology studio delivering project-based digital services, including websites, mobile apps, custom software, QR menus, e-commerce, automation and trading tools. Paid work starts only after the scope, price, payment structure and approximate schedule are agreed in writing.
Website requests and early discussions
Submitting a contact form or project request does not automatically create a contract or obligation. Initial information is used to understand the request and prepare a discussion or proposal. Work becomes binding only after a written proposal or agreement is accepted.
Proposals and scope
The project proposal or agreement defines pages, features, deliverables, revision rounds and responsibilities. Additions or changes outside the agreed scope may require a revised fee and schedule before implementation.
Payments and external costs
A deposit or milestone payments may be required before work begins or a stage is released. Amounts covering completed work, reserved time or third-party costs are non-refundable unless the written agreement states otherwise. Domain, hosting, store, gateway, API and external-service fees are separate unless included explicitly.
Client content and usage rights
The client is responsible for providing required text, images, logos, data and approvals and confirms that they have the right to use them. ZibaraTech is not responsible for claims arising from client-supplied material used without proper permission.
Delays and cooperation
Delivery schedules depend on timely content, feedback, approvals, access credentials and payments. Delays caused by the client or a third party may move the delivery schedule or require the work to be rescheduled.
Testing and acceptance
The client receives a reasonable review period for each stage or final release and should submit feedback connected to the agreed scope. After approval or launch, new requests and out-of-scope changes are additional work. Confirmed software defects remain subject to the support period agreed for the project.
Intellectual property
Ownership of agreed custom final deliverables transfers after all amounts are paid. General tools, reusable components, pre-existing code, libraries and third-party materials remain with their respective owners and are governed by their licenses.
Third-party platforms and services
Some projects depend on hosting, domains, maps, payments, messaging, app stores, AI services or APIs. These are governed by their providers’ availability, pricing and policies. Continued availability, app approval or unchanged third-party terms cannot be guaranteed.
SEO, analytics and business outcomes
SEO work may include technical, structural and content improvements when included in scope, but no particular ranking, traffic level or sales result is guaranteed. Outcomes depend on competition, content, authority, budget, time and search-engine factors.
Trading and automation tools
Trading, analysis or automation software is a technical tool, not financial advice or a promise of profit. The user remains responsible for testing, risk management and compliance with applicable laws and platform or broker rules. Markets, errors and outages may cause losses.
Cancellation, confidentiality and portfolio use
If a project is cancelled, completed work, external expenses and reserved time remain payable. Clearly identified confidential information is respected. Published work may be displayed in the ZibaraTech portfolio after launch unless agreed otherwise in writing. A project-specific proposal or contract takes priority where it conflicts with these general terms.
